This privacy statement applies to the processing of personal data by Vivet Makelaardij BV (KvK 81016077), hereinafter “Vivet Makelaardij”.

For Vivet Makelaardij, the protection of personal data is very important. Vivet Makelaardij respects your privacy and ensures that your personal information is always treated confidentially and in accordance with the applicable privacy legislation.

We do everything we can to guarantee your privacy and therefore handle personal data with care. Vivet Makelaardij complies in all cases with the applicable laws and regulations, including the General Data Protection Regulation. This means that we in any case:

Process your personal data in accordance with the purpose for which they were provided, these goals and type of personal data are described in this Privacy Policy document; Processing of your personal data is limited to only those data that are minimally necessary for the purposes for which they are processed; your explicit consent if we need it for the processing of your personal data; have taken appropriate technical and organizational measures to ensure the security of your personal data; be aware of your rights regarding your personal data, want to point this out to you and respect them.

Purposes of the processing

Personal data of landlords or sellers/prospective tenants or buyers/home seekers and third parties are processed by Vivet Makelaardij for the following purposes:

1. Administrative purposes;

2. Communication about the assignment and/or invitations;

3. Executing or issuing an order.

The basis for this personal data is:

· The agreed assignment;

· Maintaining professional contact in the context of a house (to be rented or sold);

· Keeping abreast of the current supply of rental or owner-occupied homes.

Your personal data will be stored by Vivet Makelaardij for the above processing(s) during the term of the agreement and thereafter only in the financial administration for a period of seven years.

Personal data of tenants, buyers, landlords and sellers

For the above objective(s), Vivet Makelaardij may request the following personal data from you:

First Name;Infix;Last Name;(Business) Phone Number;(Business) Email Address;Gender;Copy ID.

Legal basis for the processing

The legal basis for the aforementioned purposes of processing is:

- your consent;

- taking pre-contractual measures at your request and/or the execution of the agreement concluded with you;

- complying with legal obligations;

- the representation of legitimate interests of Vivet or of a third party.

For the above purposes, Vivet Makelaardij relies on the basis of legitimate interest. The legitimate interest lies in Vivet Makelaardij's ethical business operations, Vivet's duty of care to provide you with sufficient information and to improve the quality of our services.

You can object to these processing operations on the basis of the right of objection. More information about that right can be found later in the statement.

Mandatory provision

When we ask you for personal data, we will indicate per situation whether the provision of the data is necessary or mandatory and what the (possible) consequences are if the data is not provided. The basic principle is always that Vivet Makelaardij will not process more personal data than is necessary for the purposes described above.

Exchange with third parties

Vivet Makelaardij does not provide personal data to third parties who will use the data for their own purposes. The foregoing is only different when:

- you have given your prior consent for the relevant provision; or

- Vivet Makelaardij is legally obliged to provide data.

Automated decision making and profiling

Vivet Makelaardij does not use automated decision-making and/or profiling.

Retention period

Your data will be kept during the term of the agreement. We keep data related to business operations for the legally required period of 7 years. Your data will not be kept longer than necessary.

Security of personal data

Vivet will take or have appropriate technical and organizational measures taken to protect personal data against loss or against any form of unlawful processing.

Your rights

You have the following rights:

- Right of inspection: the right to inspect the personal data processed by Vivet Makelaardij;

- Right of correction and deletion: the right to have data changed or even deleted if the data is not (any longer) correct, or if the processing is no longer justified;

- Right to object: means that you can object to certain processing of personal data because of your specific situation. The right to object to the use of data for direct marketing purposes is absolute. Unsubscribes from our commercial communications are therefore honored in any case. In cases outside of consent and direct marketing, Vivet will make a balancing of interests;

- Right to restriction: insofar as the correctness of the data is disputed by you, you have the right to restrict the processing of your data under certain circumstances. In short, this means that Vivet temporarily “freezes” the processing of the data;

- Right to data portability: the right to transfer your data in question stored with us in a common, machine-readable format, or to request transmission to another responsible person;

- Withdrawal of consent: you have this right insofar as we process your data on the basis of your consent. You have the right to withdraw consent once given at any time. We will then immediately stop processing.

Supervisor

You are also always free to submit a complaint to the supervisory authority. The supervisory authority for privacy legislation is the Dutch Data Protection Authority. You will find the contact details of the Dutch Data Protection Authority via the website www.autoriteitpersoonsgegevens.nl.

Amendments

This privacy statement is subject to change. These changes will be announced on Vivet's website. The most recent version is from May 2021.

Vivet may process your personal data for new purposes that are not yet stated in this privacy statement. In that case, we will contact you before using your data for these new purposes, to inform you of the changes to our regulations for the protection of personal data and to give you the opportunity to refuse your participation.
